Terms of Service

These Terms of Service ("Terms") govern your use of the KasiBook appointment booking service ("the Service"), operated by CreativeMagic Solution (SA0152811-K) ("we", "us", "our"). By creating an account, accessing or using the Service, you agree to be bound by these Terms.

1. The Service

The Service lets you create and manage an online appointment booking page for your business, including staff management, availability, bookings, customer records (CRM), commission tracking, and billing. We may add, change or remove features from time to time.

2. Your account

You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Let us know immediately if you believe your account has been compromised. You must be at least 18 years old to create an account, or have the authority to use the Service on behalf of the business you register.

3. Plans, billing and payment

The Service offers Free, Solo and Team plans. New accounts start on the Free plan. Paid plans are billed in advance in Malaysian Ringgit (RM) and are paid on the hosted payment page of our payment provider SecurePay (securepay.my), which supports FPX, credit/debit cards and e-wallets. You are responsible for paying all charges on time, and you must keep your payment information current. Payments are processed by SecurePay; we do not collect or store your card details.

4. Cancellation and refunds

You may upgrade, downgrade or cancel your paid plan at any time from the Billing page. Except where required by law, fees already paid are non-refundable. Downgrades or cancellations take effect at the end of your current billing period.

5. Acceptable use

You agree not to:

  • use the Service to send unsolicited messages (spam) to your customers;
  • attempt to gain unauthorised access to the Service, other accounts, or any connected systems;
  • use the Service for any unlawful purpose or to store or transmit harmful content;
  • resell, sublicense or redistribute the Service without our written consent.

6. Customer data

You own the customer data you collect through your booking page. You are the data user under the Malaysian Personal Data Protection Act 2010 (PDPA) for that data, and you are responsible for informing your customers how their data is used and for complying with the PDPA. We process that data on your behalf to operate the Service.

7. Intellectual property

The Service, including its software, design, and content, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify or reverse engineer any part of the Service. Your content, including your business name, logo and bookings, remains yours.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, secure or error-free, and we are not responsible for missed appointments or other business outcomes that depend on your own scheduling decisions.

9. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the three (3) months before the claim. We will not be liable for any indirect, incidental, special or consequential damages, or any loss of profits, revenue, data or goodwill.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, or if required by law. On termination, your access to the Service ends, and you should export any data you wish to keep before then.

11. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new "Last updated" date. Where the changes are significant, we will make reasonable efforts to notify you. Continued use of the Service after changes take effect means you accept them.

12. Governing law

These Terms are governed by the laws of Malaysia. Any dispute arising out of these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Malaysia.
